Terms of Use

1. Acceptance of Terms
By installing or using Nightee, you agree to be bound by these Terms of Use and all applicable laws and regulations.
If you do not agree with any part of these Terms, please do not use or access the app.
Nightee provides a private, anonymous environment for adult communication and interaction.


2. Eligibility
Nightee is designed exclusively for adults (18+).
You confirm that you are at least 18 years old and legally permitted to access adult-oriented digital content and services in your country.
We do not knowingly allow or process any information from users under 18.


3. User Conduct and Responsibilities
By using Nightee, you agree to behave respectfully and responsibly toward other users. You must not:

• Share illegal, threatening, or explicit material prohibited by law.
• Harass, exploit, or impersonate others. Sending spam, unsolicited advertisements, or repetitive messages.
• Using Nightee to sell or promote paid content, services, or subscriptions.
• Sharing illegal or violent materials.
• Engaging in harassment, threats, discrimination, or hate speech.
• Attempting to scam, deceive, or impersonate other users.
• Creating multiple accounts to mislead other users or to circumvent blocks or restrictions.
• Attempt to interfere with app functionality, security systems, or moderation processes.
• Users are solely responsible for the content they share and the conversations they initiate.

Users may choose to share personal contact details at their own discretion.
However, Nightee encourages keeping communication within the app to protect anonymity and safety.
Please use caution when sharing any personal information with others.


4. Anonymity and Privacy
Nightee protects user anonymity through encrypted communication and minimal data collection.
You are responsible for any personal information you voluntarily share in chats.
Sharing private messages, photos, or screenshots of conversations outside of Nightee without mutual consent is not allowed.


5. Moderation and Safety
To maintain a secure and comfortable environment, Nightee may use both automated and manual moderation tools.
This may include:

• Detecting and blocking prohibited content.
• Restricting or removing accounts that violate these Terms or community rules.

Moderation is focused on user safety and compliance with legal requirements.


6. Accounts and Deletion
Users can delete their accounts at any time through in-app settings.
Deleting an account permanently removes all personal information, which cannot be recovered.
Nightee reserves the right to suspend or remove accounts that violate these Terms.


7. Subscriptions, In-App Purchases and Payments
Nightee may offer access to premium or additional features through in-app purchases and auto-renewable subscriptions.
All payments are processed securely by Apple via the App Store, in accordance with Apple’s payment and refund policies.
We use Adapty.io to handle subscription logic, verify purchases, and manage access to paid features.
Adapty.io processes only the minimal data required for verification and does not have access to personal user data, chat messages, or media files.
Some subscriptions may include a free trial period (typically three days).
If the subscription is not canceled at least 24 hours before the trial ends, it will automatically convert to a paid subscription.
You can cancel your trial or subscription at any time through your Apple ID settings.
Deleting the Nightee app from your device does not cancel an active or trial subscription.
After cancellation, access to premium features will remain available until the end of the current paid period.
If a user violates these Terms or engages in behavior that leads to account suspension or termination, no refunds or reimbursements will be provided for any remaining subscription time or previously purchased services.


8. Intellectual Property
All trademarks, visual elements, text, and interface designs within Nightee are the property of their respective owners.
You may not copy, modify, distribute, or reproduce any part of the app without written consent.


9. Disclaimer and Service Availability
Nightee is provided “as is” and “as available”, without warranties of uninterrupted operation, accuracy, or reliability.
While we aim for stable performance, we do not guarantee that the app will always function without errors or downtime.
In case of technical issues or suspension of service, our responsibility is limited solely to obligations under active subscriptions.


10. Service Limitations and User Accountability
Nightee and its developers are not responsible for user actions, including the sharing of restricted content or misuse of the app.
Certain app features rely on third-party services such as Firebase and Adapty; we are not liable for the availability or performance of these external systems.

Nightee and its developers shall not be liable for any indirect, incidental, or consequential damages resulting from the use or inability to use the app — including, but not limited to, data loss, account access issues, or interrupted service — even if we have been advised of the possibility of such damages.


11. Changes to These Terms
We may update these Terms of Use from time to time to reflect improvements or legal requirements.
The current version is always available on our website.
Continued use of Nightee after changes are posted constitutes acceptance of the updated Terms.
