By accessing our app, Nightee, you agree to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any local laws. If you do not agree with any of these terms, you are prohibited from using or accessing Nightee. The materials contained in Nightee are protected by applicable copyright and trademark law.
1. Use Licensea. Permission is granted to temporarily download one copy of Nightee per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- Modify or copy the materials.
- Use the materials for any commercial purpose, or for any public display (commercial or non-commercial).
- Attempt to decompile or reverse engineer any software contained in Nightee.
- Remove any copyright or other proprietary notations from the materials.
- Transfer the materials to another person or “mirror” the materials on any other server.
- Post inappropriate content or offend other users.
b. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Nightee at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.
2. Disclaimera. The materials within Nightee are provided on an ‘as is’ basis. Nightee makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
b. Further, Nightee does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its app or otherwise relating to such materials or on any sites linked to Nightee.
3. LimitationsIn no event shall Nightee or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use Nightee, even if Nightee or a Nightee authorized representative has been notified orally or in writing of the possibility of such damage. Some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, so these limitations may not apply to you.
4. Accuracy of MaterialsThe materials appearing in Nightee could include technical, typographical, or photographic errors. Nightee does not warrant that any of the materials in Nightee are accurate, complete, or current. Nightee may make changes to the materials contained in Nightee at any time without notice. However, Nightee does not make any commitment to update the materials.
5. LinksNightee has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Nightee of the site. Use of any such linked website is at the user’s own risk.
6. In-App PurchaseIf a trial period is available:
- The trial version of the subscription will take effect after the payment is confirmed. The trial period is typically 3 days. You can cancel your subscription in the subscription settings of your device’s app store account at any time. If you do not cancel your subscription at least 24 hours before the end of the trial period, your account will be charged for renewal within 24 hours before the end of the trial period. Any unused portion of the free trial period, if offered, will be canceled when the user purchases a subscription at full cost, where applicable.
- The subscription will automatically renew until it is canceled or suspended. After purchasing a subscription, every month within 24 hours before the due date of payment, you will be charged a payment amount corresponding to the subscription plan you selected. Payment will be made by the method chosen upon subscription.
- Deleting the Nightee app from your device does not cancel your subscription. The subscription will continue to be charged to your selected payment method until it is canceled. Once the subscription is canceled, you can continue to use it until the end of the paid period; the subscription will not renew after that.
- All purchases are final and non-refundable through the app. Refunds for in-app purchases or subscriptions are processed exclusively through the app store provider. Users seeking refunds must contact the app store provider directly.
- If your profile or behavior in Nightee violates these Terms of Service, your access and account may be terminated, and all payments forfeited.
7. ModificationsNightee may revise these terms of service for its app at any time without notice. By using Nightee, you agree to be bound by the current version of these terms of service.
